WE ASK THAT YOU READ THE FOLLOWING TERMS OF USE, WHICH CONSTITUTE A LICENSE THAT COVERS YOUR USE OF THIS SITE AND ANY TRANSACTIONS THAT YOU ENGAGE IN THROUGH THIS SITE (AGREEMENT). BY ACCESSING, VIEWING, OR USING THIS SITE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE WITH THESE TERMS. IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS, PLEASE DO NOT USE THIS SITE.

USE OF SITE

This website is provided solely for the use of current and future customers of MeetYourClass Inc. to provide you with information about our company, to permit you to use our services, and to enable you to contact us with any questions or comments that you may have. This site is for use by adult users of at least 18 years of age. Any use of this site by anyone under 16 years of age, or any use of this site other than the uses described in these terms is prohibited. By way of example, you should not use any features of this site that permit communications or postings to post, transmit, display, or otherwise communicate:

  • 1- any defamatory, threatening, obscene, harassing, or otherwise unlawful information;
  • 2- any advertisement, solicitation, spam, chain letter, or other similar type of information;
  • 3- any encouragement of illegal activity;
  • 4- unauthorized use or disclosure of private, personally identifiable information of others; or
  • 5- any materials subject to trademark, copyright, or other laws protecting any materials or data of others in the absence of a valid license or other right to do so.

As a User, you further agree YOU WILL NOT:

  • 1- systematically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from MeetYourClass Inc.;
  • 2- make any unauthorized use of the Site, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses;
  • 3- use a buying agent or purchasing agent to make purchases on the Site;
  • 4- use the Site to advertise or offer to sell goods and services;
  • 5- circumvent, disable, or otherwise interfere with security-related features of the Site, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the Site and/or the Content contained therein;
  • 6- engage in unauthorized framing of or linking to the Site;
  • 7- trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords;
  • 8- make improper use of our support services or submit false reports of abuse or misconduct;
  • 9- engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools;
  • 10- interfere with, disrupt, or create an undue burden on the Site or the networks or services connected to the Site;
  • 11- sell or otherwise transfer your profile;
  • 12- use any information obtained from the Site in order to harass, abuse, or harm another person;
  • 13- use the Site as part of any effort to compete with MeetYourClass Inc. or otherwise use the Site and/or the Content for any revenue-generating endeavor or unauthorized commercial enterprise;
  • 14- decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Site;
  • 15- attempt to bypass any measures of the Site designed to prevent or restrict access to the Site;
  • 16- harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the Site to you;
  • 17- delete the copyright or other proprietary rights notice from any Content;
  • 18- copy or adapt the Site’s software, including but not limited to Flash, PHP, HTML, JavaScript, or other code;
  • 19- upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party’s uninterrupted use and enjoyment of the Site or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the Site;
  • 20- upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formats (“gifs”), 1×1 pixels, web bugs, cookies, or other similar devices (sometimes referred to as “spyware” or “passive collection mechanisms” or “pcms”);
  • 21- except as may be the result of standard search engine or Internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the Site, or using or launching any unauthorized script or other software;
  • 22- disparage, tarnish, or otherwise harm, in our opinion, us and/or the Site (with exception to protections of the user’s rights offered under 15 USC 45b, et seq);
  • 23- use the Site in a manner inconsistent with any applicable laws or regulations.

IMPERSONATION AND FAKE ACCOUNTS

Prohibition of Impersonation and Fake Profiles:

  • a. Users of the site shall not impersonate, misrepresent, or create fake profiles of any individual, organization, or entity.
  • b. Users shall not use the site to deceive or mislead others about their identity, affiliation, or any other pertinent information.

Verification and Monitoring:

  • a. The site reserves the right to employ verification processes, such as email confirmation or identity authentication, to ensure the accuracy of user profiles and prevent impersonation.
  • b. The site may implement automated or manual monitoring mechanisms to detect and remove fake profiles, unauthorized impersonations, or deceptive behavior.

Reporting and Removal:

  • a. Users are encouraged to report any suspected cases of impersonation or fake profiles to the site's support team or through designated reporting channels.
  • b. Upon receiving a credible report or discovering a violation, the site may take appropriate action, including but not limited to suspending or terminating the user account, removing the impersonating or fake profile, and preserving relevant information for legal purposes.

Legal Consequences:

  • a. Users acknowledge that impersonation and creation of fake profiles may violate laws, regulations, and the rights of others.
  • b. The site reserves the right to cooperate with law enforcement agencies, disclose user information, and take legal action against individuals involved in impersonation or fake profile creation.

User Responsibility:

  • a. Users are responsible for the accuracy and truthfulness of the information provided in their profiles.
  • b. Users shall not use the site to engage in any fraudulent, malicious, or harmful activities, including but not limited to identity theft, defamation, or harassment.

USER REPRESENTATIONS

By using the site(s) or services offered by MeetYourClass Inc., you represent and warrant that:

  • 1- You agree and acknowledge that registration with the site may be required;
  • 2- Upon registration, you agree to keep your password confidential and to be responsible for all use of your account;
  • 3- all registration information you submit will be true, accurate, current, and complete;
  • 4- you will maintain the accuracy of such information and promptly update such registration information as necessary;
  • 5- you have the legal capacity and you agree to comply with these Terms of Service;
  • 6- you are at least 16 years of age;
  • 7- if you disclose any third-party account information and/or grant MeetYourClass Inc. access to any third-party account that you have the authority to grant and are entitled to disclose said information;
  • 8- you will not access the Site through automated or non-human means, whether through a bot, script, or otherwise;
  • 9- you will not use the Site for any illegal or unauthorized purpose;
  • 10- your use of the Site will not violate any applicable law or regulation.

If, in registering to use the Site, you provide any information that is untrue, inaccurate, not current, or incomplete, or you attempt to use a username that is inappropriate, obscene, or otherwise objectionable, MeetYourClass Inc. reserves the right to suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof).

With regard to “User Generated Contributions,” including without limitation, text, writings, video, audio, photographs, graphics, comments, suggestions, personal information or other material created, submitted, posted, displayed, transmitted, performed, published, distributed or broadcasted by you on the Site you represent and warrant that:

  • 1- Any Contributions you transmit may be treated as non-confidential and non-proprietary;
  • 2- the creation, distribution, transmission, public display, or performance, and the accessing, downloading, or copying of your Contributions do not and will not infringe the proprietary rights, including but not limited to the copyright, patent, trademark, trade secret, or moral rights of any third party;
  • 3- you are the creator and owner of or have the necessary licenses, rights, consents, releases, and permissions to use and to authorize us, the Site, and other users of the Site to use your Contributions in any manner contemplated by the Site and these Terms of Service;
  • 4- you have the written consent, release, and/or permission of each and every identifiable individual person in your Contributions to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of your Contributions in any manner contemplated by the Site and these Terms of Service;
  • 5- your Contributions are not false, inaccurate, or misleading;
  • 6- your Contributions are not unsolicited or unauthorized advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailings, or other forms of solicitation;
  • 7- your Contributions are not obscene, lewd, lascivious, filthy, violent, harassing, libelous, slanderous, or otherwise objectionable;
  • 8- your Contributions do not ridicule, mock, disparage, intimidate, or abuse anyone;
  • 9- your Contributions do not advocate the violent overthrow of any government or incite, encourage, or threaten physical harm against another;
  • 10- your Contributions do not violate any applicable law, regulation, or rule;
  • 11- your Contributions do not violate the privacy or publicity rights of any third party;
  • 12- your Contributions do not contain any material that solicits personal information from anyone under the age of 18 or exploits people under the age of 18 in a sexual or violent manner;
  • 13- your Contributions do not violate any federal or state law concerning child pornography, or otherwise intended to protect the health or well-being of minors;
  • 14- your Contributions do not include any offensive comments that are connected to race, national origin, gender, sexual preference, or physical handicap;
  • 15- your Contributions do not otherwise violate, or link to material that violates, any provision of these Terms of Service, or any applicable law or regulation.

Any use of the Site in violation of these representations may result in the termination or suspension of your rights to use the Site. MeetYourClass Inc., reserves the right, in its sole discretion, to determine whether User Generated Contributions violate these terms.

IN NO EVENT, INCLUDING, WITHOUT LIMITATION, A NEGLIGENT ACT, SHALL MEETYOURCLASS INC. BECAUSE SOME STATES DO NOT ALLOW THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

IN ADDITION, THE AGGREGATE LIABILITY OF MEETYOURCLASS INC. ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR OUR SERVICE WILL NOT EXCEED THE GREATER OF $100.00 OR THE AMOUNT YOU HAVE PAID US IN THIS PAST TWELVE (12) MONTHS.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless MeetYourClass Inc., its affiliates, agents, employees, and licensors from and against any and all claims and expenses, including reasonable attorney fees, arising out of or in connection with in any way to your use of the site, violation of this Agreement, violation of any law or regulation, or violation of any proprietary or privacy right.

PRIVACY POLICY

By using this site, you agree that you have accessed and reviewed MeetYourClass Inc.’s Privacy Policy governing the use of information that MeetYourClass Inc. obtains from you through your use of this website.

LIMITATIONS ON CLAIM

  • 5- a statement under penalty of perjury that you have a good faith belief that the material in question was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled;
  • 6- your physical or electronic signature.

If you send MeetYourClass Inc. a valid, written Counter Notification meeting the requirements described above, MeetYourClass Inc. will restore your removed or disabled material, unless we first receive notice from the party filing the Notification informing us that such party has filed a court action to restrain you from engaging in infringing activity related to the material in question. Please note that if you materially misrepresent that the disabled or removed content was removed by mistake or misidentification, you may be liable for damages, including costs and attorney's fees. Filing a false Counter Notification constitutes perjury.

CONTROLLING LAW, JURISDICTION, AND INTERNATIONAL USERS

This Agreement is governed by and shall be construed in accordance with the laws of the State of Michigan, U.S.A., without reference to its conflict-of-law provisions. MeetYourClass Inc. makes no representation that the materials are appropriate or available for use outside the United States. If you access this site from outside the United States, you will be responsible for compliance with all local laws. You agree to comply with all laws and regulations applicable to your use of this site. You agree to submit to the personal and exclusive jurisdiction of the U.S. District Court for the Eastern District of Michigan or a state court located in Washtenaw County, Michigan for any disputes with MeetYourClass Inc. arising out of your use of this site.

ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between MeetYourClass Inc. and you with respect to this website, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and MeetYourClass Inc. with respect to this website. MeetYourClass Inc. does not and will not assume any obligation to notify you of changes to this Agreement. ELECTRONIC COMMUNICATIONS AND ELECTRONIC SIGNATURES

You agree to be bound by any affirmation, assent, or agreement you transmit through this website, including but not limited to any consent you give to receive communications from MeetYourClass Inc. solely through electronic transmission.
